Who you are dealing with
Mateusz Filochowski, a sole trader based in Warsaw, Poland, trading as UnaidedRecall. Contact: mateusz@unaidedrecall.com.
Postal address: [virtual office address, Warsaw]. It also appears on every invoice.
The business is not yet entered in the Polish business register, so there is no NIP or REGON to quote yet. That will change and this page will change with it.
The person who runs your measurement is the person who answers your email. No part of the work is subcontracted without telling you in writing first.
What these terms cover
They cover use of this website, the free snapshot, and any paid engagement, unless a signed scope document says otherwise. Using the site or submitting a form means you accept them.
These services are offered to businesses only. They are not offered to consumers, and by engaging you confirm you are acting for purposes connected with your trade, business or profession. If a signed scope of work and these terms disagree, the scope of work wins.
What the free snapshot is
The snapshot is an indicative scan, offered free and without obligation on either side. It puts a small number of category questions to commercial AI assistants and reports what came back.
It is deliberately not a measurement. It does not use a frozen prompt set, does not report per-platform splits, and does not include competitor analysis. Those are what the paid audit is for, and the difference is stated plainly rather than buried.
There is no commitment to produce a snapshot for every request. Requests that are obviously out of scope, or from competitors, may simply not be answered.
Because it is free, the snapshot comes with no warranty of any kind and nothing should be decided on it alone. Where no fee has been paid, liability in connection with a snapshot is excluded as far as the law allows.
What cannot be promised
This matters more than anything else on this page, so it is stated without hedging:
- No position in any AI answer can be guaranteed. Nobody controls what a generative model says. Anyone who tells you otherwise is selling something they cannot deliver.
- Measurements are dated. Models are updated by their vendors without notice, and outputs vary between runs of the same prompt. Every figure reported carries the model and the date it was captured, and is true of that moment only.
- No revenue outcome is promised. Visibility in AI answers is one input to a buying process, not the whole of it.
Paid work
Scope, fee and timing for any paid engagement are agreed in writing before work starts. The audit is priced by scope and published in full on the pricing page — the price you see is the price you pay, with no negotiation. An ongoing retainer, if one follows, is quoted individually and banded to company size rather than listed publicly.
Where an audit is followed by a retainer, the audit fee is credited in full against the first invoice of that retainer.
Prices on the pricing page are stated in US dollars and are invoiced in that currency unless something else is agreed in writing. Invoices are payable within 14 days of the invoice date. Bank charges and conversion costs on your side are yours. Fees are stated exclusive of VAT or any local sales tax; where tax is due it is added at the rate in force. For business clients outside Poland the supply is generally outside the scope of Polish VAT and any tax due is accounted for by you.
A re-measurement re-runs the same unchanged prompt set and reports movement against your baseline. It is priced separately at 60% of the fee for the tier your original audit was run at. That set is kept for 12 months from the original audit so the comparison stays valid. After 12 months a re-measurement is quoted fresh, because a set that old no longer measures the same market.
Late payment carries statutory interest for commercial transactions under Polish law, and work may be paused on an overdue account after written notice. Delivery dates move by the length of any such pause.
Either side can end an ongoing engagement with 30 days written notice. Work already performed is payable. A fixed-scope audit already begun is payable in full, since the cost of it is the research, not the document.
What is expected from you
The work depends on inputs only you can give, so a short list of what it assumes:
- The information you provide about your company, its claims and its competitors is accurate, and you are entitled to share it.
- Where the work involves changes to your own website or profiles, you provide access or make the changes, and you sign off before anything is published in your name.
- Reviews and approvals come back within the agreed window. Results depend on them, and a delay on your side moves the timeline rather than compressing the work.
How the work is done, and what is never done
Moving what an AI assistant says about you means getting your company represented accurately in places it currently isn't. There is a line in that work, and it is better stated up front than discovered later:
- No fake reviews, invented testimonials, or paid sentiment dressed up as independent.
- No undisclosed paid editing. Where a Wikipedia or Wikidata entry is factually wrong, a correction is proposed through the platform's own process with the commercial relationship disclosed, as its terms require. Nothing is edited covertly.
- No sockpuppet accounts and no manufactured community discussion.
- Nothing that breaches an AI platform's terms of use — no hidden text, no prompt injection, no attempt to trick a model rather than inform it.
This is not only a matter of principle. Tactics like these get detected, reversed and penalised, and the damage lands on your brand, not on mine. If a piece of work would require any of them, it will not be quoted.
Who owns what
Reports, measurements and recommendations produced for you are yours to use inside your organisation once paid for, and to publish externally if you want to. The underlying methodology, prompt-set design, scoring framework and any tooling remain mine and may be reused with other clients. Anything you supply stays yours.
Your name will not be used as a reference or case study without your written agreement. Anonymised, non-identifying aggregate findings may be used to describe how the method performs — for example a distribution of results with no company named.
This website, its text, its design and the sample audit are mine. Reading it, quoting it with attribution and sharing the link are all fine. Republishing it as your own is not.
Reports that name other companies
Measuring your position means naming your competitors, because the finding is often that an assistant recommends them and not you. Understand what a report is: a record of what a named AI assistant produced on a stated date. It is not a statement of fact by me about any company appearing in it, including any adverse thing a model said about one, and it must not be read as one.
Reports are produced for use inside your organisation. If you want to quote one externally — in marketing, in a pitch, in anything comparative — verify the underlying claims yourself first and take your own advice on comparative advertising rules in the markets you sell into. How a report is used outside your organisation is your responsibility, not mine.
Confidentiality
Anything non-public shared during an engagement stays confidential, and will not be disclosed to anyone else or used with another client. This applies in both directions and survives the end of the engagement. It does not cover information that was already public, that you learned independently, or that the law requires to be disclosed.
Personal data
How personal data is handled is set out on the privacy page, which forms part of these terms. Where an engagement involves processing personal data on your behalf, a separate data processing agreement is signed before that processing begins.
Using this website
Use it for the purpose it exists for. Do not try to break it, scrape it at volume, overload it, or submit anything unlawful or deliberately false through a form. Automated submissions are blocked and discarded.
The site is provided as it is. It may be changed or taken down at any time, and the information on it is current at the date shown rather than continuously verified.
ChatGPT, Claude, Gemini and Perplexity are trademarks of OpenAI, Anthropic, Google and Perplexity AI respectively. This business is not affiliated with, endorsed by, sponsored by, or a partner of any of them. They are named because they are what gets measured.
Liability
Liability arising from any engagement is limited, in total, to the fees paid for that engagement in the 12 months before the claim arose.
Neither side is liable to the other for loss of profit, loss of revenue, loss of business or contracts, loss of goodwill, or any indirect or consequential loss, however it arises.
None of the above limits liability for death or personal injury, for fraud, for damage caused intentionally, or for anything else that cannot lawfully be limited under Polish law. Where a limitation in this section is found unenforceable, the rest still stands.
Events outside anyone's control
Neither side is in breach for a delay caused by something genuinely outside its control, including the withdrawal, outage or material change of a third-party AI platform. If such an event makes the work impossible for more than 60 days, either side may end the engagement and unearned fees are refunded.
Governing law and disputes
These terms are governed by Polish law, and the courts of Warsaw, Poland have exclusive jurisdiction. Where you are established outside Poland, this choice is made deliberately and is intended to apply regardless of where the work is performed or received.
Before either side starts proceedings, both agree to spend 30 days trying to resolve the matter directly. In a business this size that is usually a call, and it is usually enough.
General
- If any part of these terms is unenforceable, the rest continues to apply.
- Not enforcing something once does not waive the right to enforce it later.
- Neither side may transfer an engagement to someone else without the other's written agreement.
- These terms and the agreed scope are the whole of what was agreed, and replace any earlier discussion.
- Nothing here creates a partnership, employment relationship or agency between us.
- Notices are given by email to the addresses used for the engagement.
Changes
These terms may change. The version that applies to an engagement is the one in force when it was agreed, not whatever is on this page later.
